I. General Terms and Conditions

§ 1 Basic Provisions

(1) The following terms and conditions apply to all contracts concluded between you and us, Michael Furtner, via the website www.descend.at. Unless otherwise agreed, we do not accept any terms you may use.
(2) A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession. A business customer is a natural or legal person or a partnership with legal capacity acting in the course of their commercial or self-employed professional activity.


§ 2 Conclusion of the Contract

(1) The subject of the contract is the sale of goods.
(2) By listing a product on our website, we make a binding offer to conclude a purchase contract under the terms stated in the product description.
(3) The contract is concluded through the online shopping cart system.
You place the selected items in your "Cart", proceed through the ordering process, enter the required data, and choose your preferred payment method. Before finalizing the order, all order details will be shown to you again.
If you use an instant payment method (e.g., PayPal, Sofort, giropay, etc.), you may be redirected to the payment provider’s site, where you can review and confirm your details.
By clicking the purchase button (e.g., “place binding order”), you accept our offer and a contract is concluded.
(4) The order process is handled automatically via email. You must ensure that your email address is accurate and that receipt of emails is technically guaranteed (e.g., not blocked by spam filters).


§ 3 Payment Methods

When choosing a payment method via PayPal or PayPal Checkout, the transaction is processed by:

PayPal may engage additional payment services. Relevant terms will be disclosed accordingly.

§ 4 Right of Retention, Title Retention

(1) You may only exercise a right of retention if it concerns claims from the same contractual relationship.
(2) The goods remain our property until full payment is received.


§ 5 Warranty

(1) Statutory warranty rights apply.
(2) Consumers are kindly asked to check the goods upon delivery for completeness and obvious defects. Failure to do so does not affect your warranty rights.
(3) Deviations from objective requirements are only agreed if we have expressly informed you and you have agreed to them separately.


§ 6 Governing Law

(1) Austrian law applies, except where mandatory laws of the consumer’s home country prevail.
(2) The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.

3. Contract Language / Storage

(1) The contract language is German.
(2) The contract text is not stored permanently. You can save it using your browser's print function before submitting the order.


4. Product Features

Details are available directly in each product description.


5. Prices and Payment

(1) All prices are total prices. As a small business, no VAT is charged under § 6 (1) no. 27 Austrian VAT Act.
(2) Shipping costs are shown separately and must be borne additionally unless free shipping is offered.
(3) For deliveries outside the EU, customs duties and taxes may apply.
(4) Accepted payment methods are listed in the shop.
(5) Unless otherwise stated, payment is due immediately.


6. Delivery Conditions

(1) Delivery times: Austria 3–10 business days, international 10–20 business days after order confirmation or payment.
(2) The risk of accidental loss transfers to the customer upon delivery – except when a private courier is engaged by the customer.

  • EU: from €9,00
  • Outside EU: from €19,00
    Shipping costs are calculated automatically at checkout based on weight, parcel size, and destination.

 

Import Duties
For deliveries to non-EU countries, additional charges for customs, taxes, or other fees may apply. These are the buyer’s responsibility and are not processed via our online shop. Please contact your local customs office for details.

Right of Withdrawal for Consumers

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period starts on the day you or a third party named by you receives the goods (for partial deliveries: upon receipt of the final item).

Sending your notification before the deadline is sufficient to meet the withdrawal deadline.


Consequences of Withdrawal

We will refund all payments received from you, including shipping costs (except additional costs if you chose a different delivery option than our standard one).
Refunds will be made within 14 days of receiving your cancellation – but not before we have received the goods back or proof of their return.
You must cover the direct costs of the return shipment.
You are only liable for loss of value if it results from handling that is not necessary to examine the nature, characteristics, and functioning of the goods.


Exclusion of the Right of Withdrawal

No right of withdrawal applies to:

  • Custom-made or personalized items
  • Perishable goods
  • Newspapers and magazines (unless subscribed)
  • Sealed goods related to hygiene/health if unsealed
  • Mixed goods that cannot be separated
  • Software, audio, or video media if unsealed
